• Product: any product sold on the Website.

• We / Us / Our: The E-Cig Store Ltd (trading as Pouch Store).
• You: a user of the Website.
• United Kingdom: England, Wales, Scotland and Northern Ireland.

3. Accessing Our Website

Your access is subject to these Conditions. We reserve the right to:

• modify or withdraw the Website (in whole or part) without notice;
• change these Conditions at any time; continued use constitutes acceptance;
• block access to all or part of the Website if we suspect a breach or fraudulent activity.

4. Use of Nicotine Products

Our products are intended for adult smokers and adult nicotine-pouch users aged 18+. Many products contain nicotine, a highly addictive substance. Products should not be used by non-smokers, minors, pregnant or breastfeeding women, or those in poor health. You acknowledge you use our products at your own risk and must keep them out of the reach of children.

5. Placing an Order

The steps to create a contract between you and us are:

1. You place an order at checkout. You’ll be guided by on-screen instructions. JavaScript must be enabled to complete checkout.
2. We email an order confirmation. A contract is formed when this confirmation is sent.
3. Payment is taken at checkout by your selected method.
4. Delivery completes when products are delivered to the address you provide; responsibility passes to you at that time.

We may refuse orders due to (without limitation):

• stock unavailability;
• payment authorisation issues and/or suspected fraud;
• errors in pricing or product description;
• inability to deliver to your address;
• failure to meet eligibility criteria, including age verification.

If we cannot fulfil an item due to stock shortage, we will contact you by email and/or phone. If we receive no response within 3 days, we may cancel and refund the unavailable item(s) and confirm by email.

We may decline orders with a total value over £10,000 placed via the Website (including multiple orders over a short period). For large orders, please contact Customer Support.

We currently deliver to the United Kingdom and the Republic of Ireland. Some products may be restricted based on destination due to regulations.

6. Right to Cancel

You have a legal right to cancel your online or telephone order within 14 days of receiving the products.

• Cancellation rights do not apply to items opened after delivery or that appear used (for hygiene reasons), unless faulty.
• If you cancel, retain the products and take reasonable care of them. Do not use them.
• To cancel, email Support@pouchstore.co.uk with your name, address, order number, and contact details.
• Return products at your cost within 14 days of cancellation and keep proof of postage.
• On receipt, we will refund the product price and our standard delivery charge (if applicable). We may deduct any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
• Refunds are made within 14 days of receiving the returned goods, to the original payment method.

7. Description of Products

Each Product is sold subject to its description, including any specific conditions. We take reasonable care to ensure details, descriptions and prices are accurate when entered. However, information may not always reflect the position at the moment you place an order. We may cancel an order before dispatch where a pricing error has occurred and will refund any amounts paid.

8. Business Use

If you purchase for business use, you are responsible for appropriate insurance. To the fullest extent permitted by law, we exclude all implied warranties (including fitness for a particular purpose). Our maximum liability to business users is limited to the replacement value of the relevant product, except for death or personal injury caused by our negligence.

We may link to third-party websites or resources selected with reasonable care. You acknowledge that you access such links at your own risk; we are not responsible for their content, availability or practices.

10. Recommendations

Nothing in these Conditions excludes or limits liability for death or personal injury caused by our negligence or for fraudulent misrepresentation. Your statutory rights are not affected.

16. Severance

If any provision of these Conditions is found unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

22. Mystery Box Policy

Purchases of any Mystery Box are final sale and not eligible for returns, exchanges or shipping refunds (statutory rights unaffected). Mystery Boxes cannot be combined with other discounts or promotions. If multiple Mystery Boxes are purchased across orders, duplicate items may occur. Items are selected at random from the brands advertised.

23. Competitions & Prize Draws

• Open to UK residents aged 18+.
• Employees of The E-Cig Store Ltd and its affiliates (and their households) are not eligible.
• Winners are selected at random from eligible entries. Specific rules, entry routes and prize details will be stated for each promotion.
• By entering, you confirm you are eligible and agree to the promotion-specific terms.

24. Clearance Products

Products sold as part of a clearance deal or marked “Clearance” are final sale and not eligible for exchange or refund unless faulty or not as described under your statutory rights.
